1.

This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 600/2026 registered at Police Station Kota, District Bilaspur (C.G.), for the offence punishable under Sections 304(1), 3(5) of BNS.

2.

As per the case of the prosecution, complainant Yogesh Yadav lodged an FIR alleging that on 23.07.2026, at about 10:30 p.m., while he was returning home, the present applicant along with five co-accused persons asked him to hand over his mobile phone on the pretext of making a call and thereafter snatched the same. On such complaint, the police registered the offence against the applicant and other co-accused persons.

3.

Learned counsel for the applicant would submit that three co-accused persons have already been granted bail by the learned Trial Court. He would further submit that the applicant has two criminal antecedents registered in the years 2024 and 2025; however, none of them relates to an offence of similar nature. He would also submit that the charge-sheet has already been filed, the applicant is in jail since 26.07.2026, and the alleged snatched mobile phone has been seized from the possession of co-accused Rakesh Porte. Therefore, he would pray for grant of bail to the applicant.

4.

On the other hand, learned counsel for the State would oppose the bail application. Ms. Laxmin Kashyap, Panel Lawyer would submit that applicant has two criminal antecedents and he is involved in the commission of offence. She would submit that instant application deserves to be rejected.

5.

I have heard learned counsel appearing for the parties and perused the case diary.

6.

Having considered the facts and circumstances of the case, nature and gravity of allegations levelled against the present applicant, fact that the alleged snatched mobile phone was recovered from the possession of co-accused Rakesh Porte, three co-accused persons have already been enlarged on bail by the learned Trial Court, charge-sheet has already been filed, applicant is in jail since 26.07.2026, though the applicant has two criminal antecedents registered in the years 2024 and 2025, but there is no criminal history of similar nature, therefore, I am inclined to allow this bail application.

7.

Accordingly, the regular bail application is allowed and it is directed that in the event of the applicant executing a personal bond for a sum of Rs. 50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:-
