Judgment
B.S. Verma, J.—Heard. Learned Counsel for the Petitioners confines his prayer to relief Clause (ii) for a direction to the Civil Judge (Junior Division) Rishikesh, district Dehradun to decide the Civil Suit No. 64 of 2008, expeditiously.
It appears that the Respondents filed the aforesaid suit for a decree of permanent injunction against the Petitioners in the court below. It also appears that the application for temporary injunction was filed along with the suit, which was allowed by the trial court. An appeal was preferred by the Petitioners, which was dismissed by the appellate court.
In the above facts and circumstances of the case, the Civil Judge (Junior Division) Rishikesh (Dehradun) is directed to decide the Civil Suit No. 64 of 2008, pending in that court, expeditiously, as far as possible on merits in accordance with law, without further delay in the matter and unnecessary adjournments shall be avoided. Both the parties shall co-operate in the speedy decision of the suit before the trial court.
With the said observations, the writ petition is disposed of finally.
