Judgment
08.09.2026: This Appeal is filed against the order dated 13.07.2026 passed by the Adjudicating Authority (National Company Law Tribunal) New Delhi, Court VI in I.A. No. 724/2025 in C.P. No. 15/2017, whereby the matter before the Ld. NCLT was kept for hearing on 09.09.2026 in respect to the various IAs pending since 2020, 2022, 2024, 2025 & 2026 respectively.
It is the submission of the Learned Counsel for the Appellant the Corporate Debtor was admitted into CIRP on 10.04.2017 and upon failure of the process, was ordered into liquidation on 15.02.2018. It is the submission the workmen viz. the Appellant submitted their claim of Rs.3,27,33,780/- to the liquidator on 22.12.2018 which was admitted by the Liquidator. The Appellant had filed an IA (IBC) No.724 of 2025 on 25.01.2025 seeking disbursement of the admitted dues. The pleadings in the said IA were completed on 26.05.2025 and thereafter it has been adjourned on several occasions. It is the submission of the Ld. Counsel for the Appellant the liquidation period has been extended twice and now the matter is listed on 09.09.2026 and they shall be satisfied in case a direction is given to the NCLT to take up the said application i.e. IA No.724 of 2025 and to hear and dispose it of in due course.
In these circumstances, we dispose of this Appeal by making request to the Ld. NCLT to take up IA No.724 of 2025 as well as connected application, if any, qua disbursement, be taken up on 09.09.2026 and to hear and dispose those of in a time bound manner preferably, within four weeks from 09.09.2026.
With these observations, the appeal stands disposed of. Pending applications viz. IA No.6379 of 2026 & IA No.6380 of 2026 are also disposed of.
