The present petition u/s 482 Code of Criminal Procedure has been filed on behalf of Krishan Kumar Batra for issuing directions to Respondents No. 1 to 3 to take appropriate action against Respondent No. 5.
Learned Counsel for the Petitioner contends that Respondent No. 5 has forged the report (Annexure P-1) by adding few lines and made the material alteration, which has been detrimental to the Petitioner and due to that the Petitioner has lost his service. Learned Counsel further contends that a representation in this regard has already been sent to the Bank authorities but no action has been taken.
Heard the arguments advanced by learned Counsel for the Petitioner and have also gone through the documents available on the file.
As per allegations of the Petitioner, Respondent No. 5 has tempered/forged the report (Annexure P-1) by adding some lines and because of that reason, the Petitioner has lost his job. Since the ground for termination/dismissal of service of the Petitioner is stated to be that alteration, therefore, it is for the bank authorities to see whether any tempering is there or not, which has resulted into dismissal of service of the Petitioner. This fact cannot be seen in this petition and moreover, the Petitioner has the right to challenge the report, if the same is contrary to the fact. No ground is made out to issue any direction. The petition being devoid of any merit is hereby dismissed.
