Mr. Dilip Sharma, learned counsel for the petitioner, on the basis of instructions imparted to him by his client, submits that there is likelihood of the post becoming available for considering respondent No. 4 for promotion to the post of Superintendent Grade-II immediately after 31.12.2011. It implies that once respondent No. 4 is considered for promotion, he is likely to be posted at some other station. If that is so, in that eventuality, the petitioner, who is working at Shimla, can be accommodated/adjusted against the post which is likely to be vacated after promotion of respondent No. 4 at Sundernagar.
Accordingly, the petition is disposed of with a direction to respondents No. 1 to 3 to consider the case of petitioner for transfer from Shimla to Sundernagar, in the eventuality of respondent No. 4 being promoted to the post of Superintendent Grade-II from the feeder post of Senior Assistant and being posted out-side Sundernagar. Pending application(s), if any, also stands disposed of.
