Krishan Dayal Sharm vs State of H.P. and others

Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayer:

A. That the respondents may be directed to grant the promotion as per 25% quota meant for the JBT/C&V teachers for promotion as TGT from the date of acquiring of B.Ed Degree with all consequential benefits as applicable in case of petitioner as per law down by this Hon''ble Court in CWP (T) No. 8920 of 2008 titled as Himachal Pradesh Rajkiya Padonnat Prashkshit Sanatak Adhyapak Sangh and Others vs. State of Himachal Pradesh and Another.

According to the petitioner, the issue is covered by Annexure P-3 judgment dated 21.12.2010 in CWP No. 2 8920 of 2008 and that the judgment has been accepted and the same has been implemented, as per Annexure P-4 order passed by the Director of Elementary Education dated 25.8.2011. Therefore, this writ petition is disposed of directing the third respondent to examine the case of the petitioner herein also in case he is similarly situated as the person in whose favour Annexure P-4, order has been passed, the case of the petitioner shall be examined on the same principle. The needful shall be done and eligible benefits, if any, to which the petitioner is found entitled shall be disbursed to the petitioner within three months from the date of production of a copy of this judgment along with a copy of the writ petition and the copy of the judgment, referred to above by the petitioner before the third respondent.

The writ petition is disposed of, so also the pending applications, if any.
