Applicant is in judicial custody in Case Crime No. 201 of 2024, under Sections 363, 364, 323, 504, 506, 34 IPC, Police Station Kotwali Gangnahar, Roorkee, District Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 24.04.2024, the son of the informant was kidnapped by the applicant and the co-accused. He was assaulted, beaten up and his nude photographs have been taken by the applicant and the co-accused.

Learned counsel for the applicant would submit that the applicant is a student. It is simply a case of maar-peet. The injuries are quite simple.

Learned State counsel would submit that the injuries are simple.

The victim in his statement given to the Investigating Officer has stated that, in fact, cell phone of his girl friend was taken by one Tushar. The victim demanded cell phone from the co-accused Tushar, but he threatened the victim. On the date of incident, the co-accused Tushar alongwith some other person forced the victim to ride on the motorcycle and thereafter he was beaten up.

Admittedly, the injuries are simple in nature.

Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
