THIS appeal arises out of the order dated 5th day of May, 1997, in O.P. No. 18/96 on the file of the District Consumer Disputes Redressal Forum, Chengleput, dismissing without costs the complaint filed by one K.P. Vijayaraghavan, after holding that there was no deficiency in service on the part of the opposite parties viz., (1) Telecom District Manager, Chengleput Telecom Division, 29, Eldams Road, Madras-600018 and (2) Assistant Chief Accounts Officer, Chengleput Telecom Division, 29, Eldams Road, Madras-600018.

ARGUMENTS of learned Counsel Mr. A. Bobblie appearing for the appellant/complainant and learned Counsel Mr. S.D.N. Vimalanathan, appearing for the respondent/opposite party were heard. Even at the outset, we may point out that there are absolutely no merits to warrant interference with the order of the Forum below. It appears, as seen from the order of the Forum below, that the telephone connection of the complainant had been disconnected for non-payment in respect of two bills within the time limit stipulated therein. If such be the case, to say that there is deficiency on the part of the opposite parties, cannot at all be countenanced. This is exactly what the Forum below had done. As such the appeal deserves to be dismissed.

In fine, the appeal fails and the same is dismissed, but on the facts and in the circumstances of the case we make no order as to costs. Appeal dismissed.
