Judgment
Arindam Lodh, J
Heard Mr. S. Lodh, learned counsel appearing for the accused applicant. Also heard Mr. R. Saha, learned Addl. PP appearing for the State-respondent.
It is alleged in the complaint by the father of the victim girl that the accused-applicant had provoked his victim daughter to videograph her naked pictures. Being provoked, the victim girl sent accused person her naked videographs on good faith, but thereafter, according to the complainant, it was found that her daughter’s naked video photographs were made viral.
Mr. Lodh, learned counsel for the accused-applicant seriously disputes the contention that the accused-applicant has made the pictures/videos viral and according to him, it went viral from the mobile of the father of the victim girl itself. Learned counsel for the accused-applicant also submits that the mobile/s, laptop/s of the accused-applicant may be sent to the forensic laboratory to verify whether he sent/circulated those photographs/videos of the daughter of the complainant.
In view of this, I direct the investigating officer to collect and seize the mobile phone/s as well as the laptop that are in the custody of the accused-applicant, in course of the day. After seizure of the same, the investigating officer shall immediately produce it to the Tripura State
Forensic Science Laboratory (for short, ‘TSFSL’), Narsingarh, West Tripura by 10:30 am tomorrow(14.03.2025).
The Director, TSFSL is directed to examine and verify from which mobile and/or laptop the naked photographs/videographs of the victim girl, i.e. the daughter of the complainant were made viral. The report shall be furnished to the Court on 19.03.2025 by 10:30 am. The interim bail granted to the accused-applicant, namely, Koshik Pal, vide order dated 05.03.2025 will continue till 19.03.2025. Accused-applicant is directed to appear before the investigating officer along with his mobile and laptop in course of the day.
Send a copy of this order to the I.O. and the Director, TSFSL during the course of the day.
