Judgment
The writ petition is filed seeking a direction directing the respondents 1 to 3 not to grant any registration to new primary credit society within the area of operation of the 1st petitioner society, for a direction to consider Ext. P2 representation and pass orders in the matter of registration of new societies that are proposed within the area of operation of the 1st petitioner society and for other reliefs. Heard the learned counsel for the petitioner, learned Government Pleader for respondents 1 to 3 and standing counsel for the 4th respondent.
The grievance raised by the petitioners is that after the change in the political situation in the State, with the aid of those who are in active support of the ruling front in the State, several persons as the Chief Promoters have taken steps to register new societies of the same type and category as that of the 1st petitioner. It is said that the area of operation of these new societies overlap with that of the 1st petitioner society leading to its decline. It is submitted that the 3rd respondent has already granted registration to Paipra Agricultural Improvement Society and Mudavoor Agricultural Improvement Co-operative Society and to the 4th respondent society. The 1st petitioner society also apprehend that the 3rd respondent is taking steps to grant registration to a number of societies further proposed by some promoters in violation of Section 7 of the Kerala Cooperative Societies Act. In the circumstance, the petitioner submitted Ext. P2 representation dated 10.10.2012 to the 3rd respondent contending that highly influential promoters are trying to register new societies in the garb of being a different class of society and therefore requested the 3rd respondent to take urgent steps to stop the functioning of the society/societies that have already granted registration and not to grant registration to any new Primary Credit Society/societies in the area of operation of the 1st petitioner society. Ext. P2 is pending consideration before the 3rd respondent.
In the facts and circumstance, the writ petition is disposed of directing the 3rd respondent to consider and pass appropriate orders on Ext. P2 representation within a period of two months from the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the 1st petitioner society, 4th respondent society and other societies likely to be affected. The registration of new society/societies within the area of operation of the 1st petitioner society shall be kept in abeyance till Ext. P2 representation is disposed of.
