Judgment

Heard Mr. H. Premkrishna, learned counsel appearing for the petitioner as well as Mr. Samarjit H, Learned G.A. appearing on behalf of all the respondents.
[2] The petitioner was a member of the People Liberation Army (PLA) and subsequently surrendered before the Government of Manipur on 08.01.2001 with one wireless set and one IED.
[3] It is the case of the petitioner that the Home Department, Government of Manipur by a communication dated 19.04.1999 has adopted a scheme for Surrender-cum-Rehabilitation of Militants in the North East formulated by the Government of India, Ministry of Home Affairs. Under the said scheme, the petitioner is entitled to Rs. 24,000/- (Rupees twenty four thousand) as stipend for 12 (twelve) months at the rate of Rs. 2000/- (Rupees two thousand) per month and he also entitled to get Rs. 8,000/- (Rupees eight thousand) only as incentive money for surrendering with the wireless set and one IED. It is submitted that similarly situated person has been appointed as Riflemen/ Followers in the 4th IRB, Manipur on the basis of special DPC which was conducted on 6th to 10th September, 2002. Thereafter, on several occasions, similarly situated person has been given appointment.
[4] Despite the petitioner having surrendered before the Government of Manipur on 08.01.2001, no incentive/ stipend has been paid to the petitioner, nor any appointment has been made and therefore, the petitioner made a representation dated 27.08.2008 before the Commissioner/ Secretary (Home), Government of Manipur requesting for payment of stipend and appointment to the post of Follower. As there was no reply, the petitioner made another representation dated 23.10.2016 before the Director General of Police (DGP), Government of Manipur. However, as no positive step has been taken by the respondents, the petitioner is before this Court by way of the present writ petition.
[5] After hearing the learned counsel for the parties, this writ petition is disposed of by directing the respondent Nos. 2 & 3, the Commissioner/ Secretary, Home Department, Government of Manipur and the Director General of Police (DGP), Government of Manipur to consider the case of the petitioner for payment of stipend as well as incentive money as has been granted to other similarly surrendered persons after making necessary verification. The respondents shall examine the claim of the petitioner for appointment and afford the same to the petitioner, if others have been given appointment. Let such exercise be carried out and completed it within a period of 4 (four) months from the date of receipt of copy of the order of this Court by respondent Nos. 2 & 3.
With the above observations and directions, this writ petition is disposed of.
