Heard Mr. Ch. Momon, learned counsel appearing for the petitioner and Mr. K. Jagat, learned Government Advocate appearing for the respondents.

The case of the petitioner is that her date of birth as recorded in her educational certificates as well as in her service book is 01.03.1965. However

while recording her particulars in the employee personal detail in the CPIS database it has been wrongly recorded as 01.03.1956. On learning about

the mistake committed by the authority, petitioner promptly submitted a representation dated 06.06.2019 to the Director of Education (S), Government

of Manipur requesting for correction of her date of birth as 01.03.1965 in place of 01.03.1956 as wrongly recorded by authority in the CPIS database.

Acting on the representation of the petitioner the Zonal Education Officer, Churachandpur, Government of Manipur informed the Nodal Officer

(CPIS), Directorate of Education (S), Government of Manipur by letter dated 12.06.2019 requesting for correction of the personal information of the

petitioner in the CPIS(MGEL) database particularly the date of birth of the petitioner as 01.03.1965 in place of 01.03.1956. Subsequently the Director

of Education(S), Government of Manipur, also wrote a letter dated 11.07.2019 to the Commissioner, Education(S) bringing to the notice of the

Commissioner, Education (S), who is the administrative Head of the Department of Education (S), informing about the error committed in recording

the date of birth of the petitioner in the CPIS database and requesting for issuing appropriate order for correction of the date of birth of the petitioner

in the CPIS database as 01.03.1965 instead of 01.03.1956, since such order is required for making such correction. Even after about 5(five) months

from the date of giving information by the Director of Education (S), to the Commissioner, Education(S) no action has been taken up for making

necessary correction in respect of date of birth of the petitioner. It is submitted that due to such lapse on the part of the respondents, petitioner is

suffering as she is not getting her pay and allowances since the month of June, 2020 till date. Accordingly, the learned counsel appearing for the

petitioner prayed that this present writ petition may be disposed of by directing the respondents to take speedy and appropriate action for correction of

the date of birth of the petitioner. Mr. K. Jagat, learned Government Advocate appearing for the respondents fairly submitted that the present writ

petition can be disposed of by directing the respondents to take necessary step for correcting the date of birth of the petitioner.

In view of submission made above, this writ petition is disposed of with the following directions ;

(i) The Commissioner of Education (S) should consider the letter dated 11.07.2019 of the Director of Education (S), Manipur with regards to the

correction of the date of birth of the petitioner and issue necessary order within a period of 2(two) weeks from the date of the receipt of this order,

(ii) After issuance of the necessary order by commissioner of Education (S), Government of Manipur for correction of the date of the petitioner, the

respondent No.3 should take up necessary step for correction of the date of birth of the petitioner as 01.03.1965 instead of 01.03.1956 in the relevant

CPIS database within a period of one week.

(iii) After correction of the date of birth of the petitioner in her service profile in the CPIS database, respondents should release her pay and

allowance due payable to the petitioner within a period of 1(one) month thereafter.

With the aforesaid directions, the present writ petition is disposed of.
