The father of the applicant was Sub-Inspector with Delhi Police who passed away on 03.09.2016. The applicant submitted an application for compassionate appointment on 21.03.2017, after which the respondents wrote to the applicant on 07.04.2017 (Annexure A-1) for completion of requisite formalities so that the case could be taken up for enlistment. As per the applicant, she submitted all the necessary papers, except, an NOC from all family members. She has stated that she does not enjoy good relations with other family members and has prayed for waiving the condition of NOC from family members.
Ms Esha Mazumdar, learned counsel for respondents appears on advance notice.
MA No. 666/2021 has been filed for condoning delay of 1042 days. Since the matter pertains to compassionate appointment, delay in filing the OA is condoned. However, this is without prejudice to the rights of the respondents.
Since the question of who among the family members of the deceased is entitled to compassionate appointment is not within the jurisdiction of this Court, therefore, the claimed relief cannot be granted. However, it is open to the applicant to approach the appropriate forum.
With these directions, OA is dismissed. No order as to costs.
