Judgment
R. Basant, J.—This judgment must be read in continuation of our earlier orders resting with the order dated 28.07.2010.
The petitioner has filed this petition for issue of a writ of habeas corpus to search for, trace and produce his wife Deepika, aged 28 years, who was continuing to reside along with respondent Nos. 2 and 3, his father in law and mother in law. The petitioner apprehended that his wife Deepika, the alleged deenue, was under illegal confinement and detention of respondent Nos. 2 and 3 from 28.01.2009.
Respondent Nos. 2 and 3 appeared before this Court. The alleged detenue appeared along with them. The petitioner along with his parents have also come before this Court today.
We are happy to note that after exhaustive and detailed discussion between the parties, the parties have come to broad understanding and agreement and have settled their problems and disputes.
The parties agree and accordingly we issue the following directions:
i) The alleged detenue and the petitioner - spouses, shall today reside in any hotel at Ernakulam;
ii) They shall proceed together to the house of respondent Nos. 2 and 3 at Nangiarkulangara tomorrow (14.08.2010);
iii) On 15.08.2010, the petitioner and the alleged detenue shall proceed to their place of residence at Bangalore;
iv) All concerned agree to forget and forgive all the events that have taken in the past and to ensure that a healthy, happy and harmonious married life is led by the petitioner and the alleged detenue at Bangalore;
v) The petitioner agrees that the alleged detenue shall be at liberty to take up employment at Bangalore and that he shall do everything possible to ensure that she is respectably employed at Bangalore;
vi) It is agreed between the spouses that the gold ornaments kept by her in a bank locker in Bangalore operated jointly by both the spouses, shall be taken by her and placed in a bank locker to be operated by them jointly in Alappuzha district at the earliest;
vii) The petitioner and the alleged detenue agree that they shall visit the parents of the alleged detenue periodically - at least twice a year.
This Writ Petition is accordingly allowed in part. The alleged detenue Deepika and the petitioner Anil are permitted to leave the Court together as desired by all concerned.
