The writ petition has been filed for a direction to the respondents 2 & 3 to afford the petitioner an opportunity of being heard on the issues projected in Exts.P1 and P3 before finalising the alignment and design or within such time as may be fixed by the Hon'ble Court.
The petitioner had submitted Exts.P1 & P3 and replies had also been given by the concerned authority. The petitioner is not happy with the reply that has been received and he feels there is much more to be stated about the design which he wants to address at the personal hearing. There is no such right available to the petitioner, which can be in any manner entertained by this Court. If such a right is given to any resident, that can only lead to a situation where every resident can come up with writ petitions seeking an audience with the concerned persons for finalising the alignment. There is no such statutory requirement nor any fundamental right.
The writ petition fails and is dismissed.
