Judgment
S. Siri Jagan, J.—The 1st petitioner was working as General Foreman at Ernakualm in the Government Press. The 2nd petitioner was working at Government Press, Mannanthala. They were granted transfers to Shornur and Ernakulam respectively in June, 2008 on their request. Their transfers have been cancelled by the Director by Ext.P2 order. It is challenging Ext.P2 order, the petitioners have filed this writ petition seeking the following reliefs;
(a) call for the records relating to Exhibits P2 and quash the original of the same to the extent it orders cancellation of the transfer given to the petitioners vide Exhibit P1 by the issue of a writ of certiorari or other appropriate writ or order.
(b) issue a writ of mandamus or other appropriate writ or order or direction commanding the Respondents to allow the petitioners to continue at Shornur and Ernakulam respectively.
On 15.7.2008, this Court passed the following interim order in this case.
The operation of Ext.P4 has been directed to be kept in abeyance by this Court in the writ petitions filed by persons whose temporary promotions under Ext.P3 have been directed to be cancelled by the Government. Petitioners apprehend that as a consequence of the order cancelling promotion, petitioners might be transferred on a review of Ext.P2. In the circumstances, it is made clear that if there is a proposal to transfer the petitioners from the station to which they have been posted under Ext.P2, that shall not be given effect to, except after getting orders from this Court.
I am of opinion that insofar as more than two years have elapsed after the event, there is no point in considering the matter on merits. Accordingly, this writ petition is closed without prejudice to the right of the petitioners to approach this Court again, if they are transferred, provided they have still grounds to challenge the orders of transfer.
