Judgment
A. Guneshwar Sharma, J
[1] Present Mr. S. Chittaranjan, learned counsel for the appellant/applicant; and Mr. M. Rarry, learned Special P.P. for the State.
[2] At the outset, Mr. M. Rarry, learned Special P.P., submits that he is ready to argue both on the appeal and application.
[3] Mr. S. Chittaranjan, learned counsel, is also agreeable to the suggestion. However in the main appeal i.e., Cril. A. No. 11 of 2023, this Court admitted the appeal on 18.07.2023 and call for record form the Trial Court. The record is yet to be received by the Registry.
[4] In the circumstances, the matter could not be heard today in absence of the original record.
[5] List these cases on 18.08.2023, both for hearing on appeal as well as application.
[6] Mr. S. Chittaranjan, learned counsel for the appellant, submits that the interim protection given by the Trial Court is expiring on 30.07.2023 and if the interim order is not extended till the next date, it will cause irreparable loss and injury to the appellant and prays that interim order may be extended till the next date.
[7] In the circumstances, the interim order dated 02.05.2023 passed by the Trial Court is extended till the next date on the same condition.
[8] Send a copy of this order to the learned Special Judge (SC &ST POA), Senapati, for information and to expedite sending of the original record.
[9] Furnish a copy of this order to the learned counsel appearing for the parties in the course of the day.
[10] Registry is directed to reflect the name of Mr. M. Rarry, learned Special P.P. in the cause-list.
