The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.415/2019, registered at Police Station Pandri, District Raipur (C.G.), for the offence punishable under Section 509B of IPC.
The applicant has recorded the video calling with the prosecutrix while she was changing clothes and later on he circulated the recorded video to several persons including the witnesses Nakul Verma, Tarkeshwar Verma and Yugal Kishore.
Learned State counsel would oppose the prayer for grant of bail.
Considering the fact that the SIM and mobile set, through which the alleged video calling was made, is registered in the name of one Pitambar Tandi and not in the name of the applicant, as also for the reason that the offence is trailable by the Judicial Magistrate First Class carrying punishment up to 2 years, though providing minimum punishment of 6 months, this Court is inclined to release the applicant on bail.
Accordingly, the bail application is allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
