The perusal of the order sheets would reflect that several Learned Counsels had appeared on behalf of the Respondent Bank and someone had also appeared on behalf of Respondent No.2/Auction Purchaser. However, there is presently no representation on behalf of either of the Respondents.

The Learned Counsel for the Appellant would submit that Respondent No.1/Bank and Respondent No.2/Auction Purchaser appear to have lost interest in the appeal, as the property has been sold and possession thereof has been handed over to Respondent No.2/Auction Purchaser. He would further submit that Respondent No.2/Auction Purchaser has also sold the said property to Respondent No.3. He would further submit that I.A. No. 35/2024 filed by the Appellant was allowed for impleading the subsequent purchaser of the property. However, the paragraph numbers in the said application have been wrongly mentioned. Therefore, I.A. No. 383/2025 has been filed seeking correction of the same.

Accordingly, I.A. No. 383/2025 is allowed.

The Appellant is directed to carry out the necessary amendment and file the amended Memo of Appeal within two weeks from today.

Issue notice to the Respondent No.3 by registered speed post.

Steps be taken within one week.

List the case on 05.11.2026 before the Ld. Registrar for report.
