Judgment
Hon'ble Pankaj Purohit, J.
Petitioner is a registered Class-C Contractor and is engaged in civil work under the Public Work Department. He was awarded one contract on 03.04.2023 being the lowest bidder for reconstruction of damaged wall on the National-Highway-87 extension (New N.H.-109) at Village Simalkhet, Post Office Pandawakhal, Tehsil Chaukhutiya, District Almora. The said work was completed by petitioner on 02.05.2023.
Learned counsel for the petitioner submits that petitioner has not been paid a single penny for the work done by him and accordingly a sum of ₹19,19,478/- is pending with the respondent-Department since the year 2023.
Learned State Counsel, on instruction, submits that the dues payable to the petitioner are admitted by the respondent-Department but due to lack of fund, the same has not been disbursed to him. He further submits that respondent-department may be granted some time to disburse the said amount.
In such view of the matter, writ petition is allowed. The respondent no.1 is directed to make payment of the admitted dues i.e., ₹19,19,478/- to the petitioner within a period of four months from the date of production of certified copy of this order.
