Issue notice. Learned counsel appears and accepts notice on behalf of the respondent.

The limited prayer sought by the petitioners in the present writ petition is to seek a direction to the Motor Accident Claim Tribunal/ Additional District Judge, Kotdwar, Pauri Garhwal to dispose of Misc. Civil Case (Refund) No.19 of 2023, “Kiran Joshi & others vs. United India Insurance Company Ltd.”. The petitioner is also seeking release of the amount of Rs.84,12,969/- in terms of the judgment dated 01.10.2022, passed by Motor Accident Claims Tribunal/ Additional District Judge, Kotdwar, Pauri Garhwal in MACT No.18 of 2020.

We dispose of this petition with a direction to the Motor Accident Claim Tribunal/ Additional District Judge, Kotdwar, Pauri Garhwal to endeavour to dispose of Misc. Civil Case (Refund) No.19 of 2023, on the next date of hearing fixed before it.

We, however, make it clear that this Court has not examined the merits of the petitioner’s claim.

The writ petition is disposed of in the aforesaid terms.
