Judgment
L.N. Mittal, J.—Accused Kiran has filed this petition for anticipatory bail in case FIR No.97 dated 25.08.2011, under Sections 457 and 380 of the Indian Penal Code (in short - IPC), registered at Police Station Lambi, District Sri Muktsar Sahib.
I have heard learned counsel for the parties and perused the case file.
Theft of gold ornaments worth about Rs.7.5 lacs and cash amount of Rs.2.5 lacs took place in the house of complainant. The petitioner is alleged to have made extra judicial confession that she, along with her co-accused brother and one more person, committed the aforesaid theft.
Learned State counsel, on instructions from ASI Prem Chand, submitted that the petitioner has made extra judicial confession. Learned State counsel also stated that petitioner''s two co-accused including her brother have since been arrested and small part of stolen property has been recovered, but the remaining stolen property is yet to be recovered.
Keeping in view all the circumstances of the case including alleged extra-judicial confession made by the petitioner and nature of offence and value of stolen property, the petitioner does not deserve the concession of anticipatory bail.
Dismissed, without meaning to express any opinion on merits of the case.
