The applicant has applied for transfer of the Original Application (O.A.) No. 171 of 2020 on the files of the Debts Recovery Tribunal, Pune (D.R.T.) to any other D.R.Ts. for the reason that though the O.A. has been pending for five years, owing to his ill health, the Ld. Presiding Officer may not be in a position to dispose of the O.A. expeditiously.
In case the application for transfer of the O.A. to any other D.R.T. is considered, there are two D.R.Ts. lying vacant in Mumbai. There is also one D.R.Ts. lying vacant in Ahmedabad and Aurangabad. Therefore, no purpose will be served by transferring the O.A. to any other D.R.Ts. available, as they are overburdened. Hence, this transfer application is disposed of with the direction to the D.R.T., Pune to dispose of the O.A. as expeditiously as possible as provided by the statute, considering the fact that it has been pending for five years and it is also considering the fact that the applicant is a third party.
