Judgment
Mr. Juno Rahman, learned counsel appearing for the petitioner, states that only an affidavit has been filed pursuant to the earlier dated 17.02.2021.
The same is not put up on file. He further states that an application has now been made before the Revenue Authority to secure a copy of the
mutation record.
He, however, concedes that there is no document of title available, whereby the petitioner can prove that the respondent relinquished his rights in the
subject immovable property in her favour.
Further, Mr. Juno Rahman, learned counsel, would inform this Court that the connected matter in CRP (CRP Art. 227) No. 1 of 2021 has already
been entertained and notice was issued therein with interim relief.
However, this Court is not inclined to pass any interim order at this stage, keeping in mind the fact that the petitioner is not in a position to demonstrate
her exclusive rights over the property in question by way of any independent document.
Notice before admission, returnable on 03.03.2021.
Steps to be taken for effecting service of notice upon the respondent for the said date. Service by Speed Post is also permitted.
