By means of this petition moved u/s 482 of Code of Criminal Procedure, 1973, (for short CrPC) the Petitioners have sought quashing of the proceedings of Criminal Case No. 30 of 2009, State v. Khivraj and Ors., relating to offence punishable u/s 500 IPC, and one punishable u/s 3/4 Dowry Prohibition Act, 1961, Police Station Haldwani, pending in the Court of Additional Chief Judicial Magistrate, Haldwani.

Learned Counsel for the parties stated that complainant, and the accused have entered into compromise, and the complainant does not want to prosecute the Petitioners. The complainant is present in person in the court alongwith his counsel. He verified the fact that he does not want to prosecute the Petitioners after marriage of his daughter Neeru.

In the above circumstances, the compounding application No. 473 of 2011, is allowed.

In view of principle of law laid down in B.S. Joshi and Others Vs. State of Haryana and Another, , impugned proceedings of Criminal Case No. 30 of 2009 State v. Khivraj and Ors., relating to offence punishable u/s 500 IPC, and one punishable u/s 3/4 Dowry Prohibition Act, 1961, Police Station Haldwani, pending in the court of Additional Chief Judicial Magistrate, Haldwani., are hereby quashed, and the Petitioners shall stand acquitted from the charge. The petition stands disposed of.
