Learned counsel for the parties are present.
This criminal revision has been filed against the Judgment dated 21.2.2024 passed by the learned Sessions Judge, Chaibasa in Criminal Appeal Nos. 106 of 2023 and Criminal Appeal No. 108 of 2023 affirming the Judgment of conviction and order of sentence both dated 22.8.2023 passed by the learned S.D.J.M., Sadar, West Singhbhum at Chaibasa in G.R. Case No. 202 of 2017 (T.R. No. 83 of 2023) arising out of Hatgamharia P.S. Case No. 12 of 2017 whereby the petitioners have been convicted u/s 414/34 of the Indian Penal Code and has been sentenced to Undergo R.I. for 2 years with a fine of Rs. 5,000/- each and in default of payment of fine, S.I. for one month.
I.A. No. 6241 of 2024 has been filed for grant of bail to the petitioners during the pendency of this criminal revision.
Learned counsel for the petitioners submits that although the charge was under sections 30,33,42,44 of the Indian Forest Act and Section 414/34 of the Indian Penal Code but the petitioners have been convicted under Section 414/34 of the Indian Penal Code. Learned counsel submits that the records be called. The petitioners are in custody since 13.06.2024 and have also remained in custody for a period of one and a half month during trial, be enlarged on bail. Learned counsel for the petitioners has undertaken before this court that he would argue the case as and when the date is fixed by this court.
The learned counsel for the State has submitted that records would be required for the purposes of disposal of this case.
Office is directed to call for the records from the concerned court.
Considering the facts and circumstances of the case and also the custody of the petitioners, the petitioners are directed to be released on bail, during pendency of this criminal revision, on furnishing bail-bonds of Rs. 25,000/-(Rupees twenty-five thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Sadar, West Singhbhum at Chaibasa in connection with Hatgamharia P.S. Case No. 12 of 2017, corresponding to G.R. No.202 of 2017, subsequently T.R. No. 83 of 2023, subject to following conditions:
(i) One of the bailors should be close relative of the petitioners.
(ii) The petitioners shall deposit a self-attested copy of their Aadhar Card along with their Mobile Numbers which they shall not change during the pendency of this case.
I.A. No. 6241 of 2024 stands disposed of.
Post this case on 18.09.2024 for ‘Final Disposal’.
