I.A. No.143 of 2022
This I.A. has been filed for condonation of delay of 1000 days in filing the Criminal Revision.
This revision has been filed challenging the order dated 02.03.2019 passed by the learned Addl. Sessions Judge, Salipur in Criminal Appeal No.69 of 2017 dismissing the case for non-prosecution as no steps had been taken by the parties and neither the appellant nor the respondent was present in the learned Court below on repeated calls at regular interval.
Ms.Saubhagyalaxmi Patnaik, learned counsel appearing on behalf of the opposite party No.2 submits that Criminal Appeal No.69 of 2017 had been filed by the petitioner challenging the order dated 17.04.2017 passed in Crl. Misc. Case No.103 of 2014 wherein an award of Rs.5,000/-has been made for payment of monthly interim maintenance which was to be paid to the opposite party No.2 in the 1st week of each succeeding month. Till date the opposite party No.2 has received only Rs.30,000/-(Rupees thirty thousand) which the petitioner had deposited in the learned Court below pursuant to order dated 07.07.2022 passed by this Court.
List this matter on 08.04.2024.
In the meanwhile, the petitioner shall deposit a further amount of Rs.30,000/- (Rupees thirty thousand) in the Court of the learned J.M.F.C., Salipur. This amount of Rs.30,000/- (Rupees thirty thousand) on being deposited by the petitioner, shall be released in favour of opposite party No.2.
