The petitioner who was a Guest Faculty Teacher is aggrieved by the action of the respondents/authorities in not complying with the Circular dated 06.02.2010 issued by Deputy Secretary, Govt. of M.P., School Education Department,Bhopal whereby a decision was taken to appoint Guest Faculty Teachers on payment of honorarium @ pay minus pension.

The contention of the petitioner is that she was retired from the post of Assistant Teacher on 30.06.2017, and thereafter was appointed as Guest Faculty Teacher from from 21.07.2017 to 31.12.2017 at Govt. Primary School, Singarpur. However, instead of making the payment as per Circular dated 06.02.2010, she has been paid Rs.100 per day only. It is submitted that in a similar matter WP No.9629/2017 (Narayan Prasad Patel vs. The State of M.P.), this Court vide order dated 10.01.2019 has directed to make the payment of honorarium @ pay minus pension. It is stated that petitioner has also filed a representation in this regard before the District Education Officer,Jabalpur on 25.07.2019, but no action on the same has been taken till date.

Learned Panel Lawyer appearing for the respondents/State has fairly concedes to the fact that vide circular dated 06.02.2010, the State Government has directed to pay the honorarium @ pay minus pension to the Guest Faculty Teachers. However, he submits that in case the petitioner files a fresh representation before the DEO, Mandla, it will be decided in the light of order passed by this Court in WP No.9629/2017.

Considering the aforesaid, this petition is disposed of with a direction that on filing a fresh representation by the petitioner for payment of honorarium @ pay minus pension, before the respondent no.2/District Education Officer, Mandla, within a period of fifteen days from today, along with a certified copy of the order passed today, the DEO shall decide the same in the light of the Circular dated 06.02.2010 and the order dated 10.01.2019 passed by this Court in WP No.9629/2017, and after verifying the certificate produced by the petitioner that she had worked from 21.07.2017 to 31.12.2017 as Guest Faculty Teacher at Govt. Primary School, Singarpur, the arrears shall be paid to her within a further period of sixty days.

With the aforesaid directions, the petition stands disposed of.
