Judgment
Hon’ble Pankaj Purohit, J. (Oral)
By means of the present writ petition, petitioner has sought the mandamus directing the respondent-authorities to verify and correctly calculate his NPS dues and release the amount of Rs. 2,00,382/- along with any further amount found due and payable to him in accordance with law and further directing respondents to consider and decide his representation dated 24.08.2026 within stipulated time.
Petitioner was serving as a Cleaner in respondent PWD, who retired from service on 31.08.2019. After his retirement, the retiral benefits were released after considerable delay of approximately one year, however, the amount pertaining to National Pension Scheme (NPS) account remained unpaid. He approached the concerned department for calculation and release of the amount due towards his NPS account, however, the respondents have failed to release the outstanding amount to him. Thereafter, he submitted several representations to the respondents, but no decision has been taken as yet.
After arguing a while, learned counsel for the petitioner made an innocuous prayer that if petitioner is permitted to make a fresh representation ventilating his grievance to competent authority and if a direction is issued to competent authority to decide the same within stipulated time, the ends of justice would be met.
Learned counsel for the State has no objection if such an order is passed by this Court.
Accordingly, the writ petition is finally disposed of. Petitioner is directed to make a fresh representation to competent authority within two weeks from today and if such representation is made by the petitioner, competent authority shall take a decision on the same by a reasoned and speaking order within six weeks from the date of receipt of representation.
