Applicant-Khankru, who is in jail in connection with Range Case No. 06 of 2010-2011, relating to offence punishable u/s 51, 2/51, 9/51, 27/51, 29/51 and 39/51 of Wild Life Protection Act, 1972, has sought his release on bail.

Learned Counsel for the Applicant submitted that Applicant has no criminal history. It is further pointed out that there is no independent witness of the recovery. One skin of leopard and gall bladder of bear is said to have been recovered from the Applicant. Applicant is in jail since 6th of March of 2011.

Having considered submissions of learned Counsel for the parties, without expressing any opinion as to final merits of the case, this Court is of the view that the Applicant deserves bail. Bail Application is allowed.

Let the Applicant- Khankru be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Uttarkashi.
