Judgment
P. Sathasivam, J.—The petitioner, by name Khaja Moideen, filed this petition for production of his wife Sangeetha D/o Thyagarajan before
this Court and set her at liberty forthwith.
Pursuant to the direction of this Court, the detenue Sangeetha appeared before us. According to her, she is aged about 24 years. Though she
admitted that she married the petitioner on 07.04.2006, she prefers to stay with her parents, particularly, with the third respondent, who is none
else than her father. Even after explaining the fact that she married the petitioner on 07.04.2006, she determined and asserted that she prefers to
stay with her father only.
In the light of her assertion and she being a major aged about 24 years, we are not inclined to go into the validity or otherwise of the marriage
said to have been taken place on 07.04.2006. We permit the petitioner to stay along with her father, according to her wish. The parties are at
liberty to move before the appropriate Forum to vindicate their grievance, if they so desire.
With the above observation, this petition is closed.
