Judgment
This matter is taken up through hybrid mode.
Mr. Mishra, learned counsel for the Petitioner submits that her land has been acquired under the provisions of Railways Act, 1989, as amended in 2008 (for brevity, ‘the Act’). Since there is a dispute with regard to apportionment of the compensation, the Competent Authority, Land Acquisition in exercise of power under Section 20-H(4) of the Act, deposited the amount with learned Civil Judge (Senior Division), Sundargarh, but the land situates within the local jurisdiction of learned Civil Judge (Senior Division), Rourkela. Further, the Competent Authority, Land Acquisition vide his order dated 17th June, 2025 in Misc. Case No. 06 of 2025 referred the case record to the principal Civil Court, Sundargarh, namely, learned District Judge, Sundargarh.
In course of hearing, Mr. Mishra, learned counsel for the Petitioner requested to keep the matter pending and to permit him to move the application before the learned District Judge, Sundargarh to do the needful.
He is so permitted.
Learned District Judge, Sundargarh shall act upon production of certified copy of this order.
Put up this matter on 18th February, 2026, on which date, Mr. Mishra, learned counsel for the Petitioner shall apprise the developments.
