Heard Mr. Ritesh Sharma, learned counsel for the petitioner. Also heard Mr. Gagan Tiwari, learned Deputy Government Advocate, appearing for respondent No. 1/State and Ms. Seema Mishra, learned counsel holding the brief of Mr. Abhishek Singh, learned counsel, appearing for respondent No. 2.

The present writ petition has been filed by the petitioner with the following prayers:

“i. That, this Hon’ble Court may kindly be pleased to call the entire records pertaining to the bid such as approval, sanction, note sheet etc. from respondent No.2.

ii. That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, writs, order, direction to strict adherence to the Chhattisgarh State Store Purchase Rules by all Municipal Corporations (Nagar Nigam) and Municipal Councils (Nagar Palika Parishad & Nagar Panchayat) within the state.

iii. That, this Hon’ble court may kindly be pleased to issue an appropriate writ, writs, order, direction to set aside Bid No. GEM/2023/B/3888123, considering the irregularities and legal infringements that have marred the bidding process.

iv. That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, writs, order, direction to respondent No. 2 to initiate fresh bid notifications for each item separately, ensuring strict adherence to all relevant laws, rules, and regulations governing public procurement. This step is necessary to guarantee transparency, fairness, and legality in the bidding process.

v. Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted, in the interest of justice.”

It is submitted by learned counsel, appearing for respondent No. 2 that the tender in question has already been cancelled.

In view of the submission made by the learned counsel, appearing for respondent No. 2, the present writ petition is disposed off.
