The learned Government Pleader takes notice for respondents 1 and 2. Sri.Mansoor Ali K.A, the learned counsel takes notice for the 3rd respondent. Issue urgent notice by speed post to the 4th respondent.
Sri.R.K.Muralidharan, the learned counsel appearing for the petitioner would refer to Ext.P2 approved seniority list and it is pointed out that the petitioner is the seniormost HSST. The learned counsel would point out that though by Ext.P3 order, the 2nd respondent had permitted one Abdul Jaleel to function as Principal in charge. Later, pursuant to directions issued by this Court in Ext.P4 judgment, the 2nd respondent had recalled Ext.P3 order and had given charge of Principal to the petitioner, which fact would be evident from Ext.P6. He contends that the 2nd respondent has now recalled Ext.P6 and has appointed the 4th respondent as Principal in charge and the drawing and disbursing officer by Ext.P9 impugned order. According to the learned counsel, the 4th respondent is a Junior HSST and Serial No. 15 in Ext.P2 seniority list and his appointment would go against the principles laid down by this Court in Ext.P10 judgment.
Having considered the submissions, I am of the view that the petitioner has made out a good case on merits. The operation and enforcement of Ext.P9 order will stand stayed and the petitioner shall be permitted to act in terms of Ext.P6.
