This is the first bail application filed by the applicant under Section 439 of the Cr.P.C. for grant of bail in connection with Crime No.204/2020 for the offences punishable under Sections 302, 307, 147, 148 and 149 of IPC registered at Police Station- Diguara District-Tikamgarh.

A t the very outset, learned counsel for the applicant has drawn the attention of this court to the order passed by it on 01-10-2021, in M.CR.C Nos. 26017/21, 41202/21 and 45451/21, by which this court had granted bail to the co-accused Suraj Ahirwar, Deshraj Singh Lodhi and Bragbhan Lodhi and was granted the benefit of bail by this court in the aforementioned cases.

The considerations which prevailed in the mind of this court while granting bail to the co-accused persons are identical to the case of the applicant herein.

Under the circumstances, on the grounds of parity, the application is allowed and it is directed that the applicant shall be enlarged on bail upon his furnishing a personal bond in the sum of Rs.50,000/- (Fifty Thousand Only) with one surety in the like amount to the satisfaction of the learned trial court.

The jail authorities shall have the applicant checked by the jail doctor to ensure that he is not suffering from the Corona Virus and if he is, he shall be sent to the nearest hospital designated by the State for treatment. If not, he shall be transported to his place of residence by the jail authorities.
