It is seen from the order passed by Mr. D.N. Panda, the third Member Judicial) of the Customs, Excise and Service Tax Appellate Tribunal on 28th October, 2013 [2014 (314) E.L.T. 138 (Tribunal)] that while he disagreed with the Member (Technical) on the question of permitting the Appellant to amend the shipping bill, there was no disagreement with the view of Mr. Mathew John, the other Member (Technical) that the Appellant was otherwise entitled to claim the benefit under the VKGUY Scheme. It is stated that the Appellant has made a representation on 10th July, 2014 to the Director General of Foreign Trade (''DGFT'') for being granted the benefit under the VKGUY Scheme and that the decision of the DGFT thereon is awaited. The Court permits the Appellant, on the strength of the present order, to write to the DGFT to enquire about the outcome of its representation and seek a copy of the decision thereon. A copy of the said decision if made available be placed on record before the next date. In the event the DGFT has not yet taken a decision on the Appellant''s representation, it is requested to do so not later than two weeks after the receipt of the Appellant''s letter.
