Judgment
V. Narasingh, J
Heard learned counsel for the petitioner and learned counsel for the State.
Learned counsel for the petitioner files a memo stating therein that the case has been committed and numbered as C.T. (Sessions) Case No.121 of 2023 pending before the learned ADJ, Bhawanipatna.
The petitioner is an accused in connection with C.T. (Sessions) Case No.121 of 2023, pending before the learned ADJ, Bhawanipatna, arising out of Lanjigarh P.S. Case No.37 of 2023, for alleged commission of offences under Sections 376(2)(n)/417 of IPC.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna, by order dated 10.07.2023 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that the petitioner is in custody since 24.05.2023 and as charge sheet has been filed on 30.06.2023, he may be released on bail.
Learned counsel for the State opposes the prayer for bail.
Perused the 164 Cr.P.C. statement of the victim.
Considering the tenor thereof, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.
Accordingly, the BLAPL stands disposed of.
Urgent certified copy of this order be granted as per rule.
