Judgment
The petitioner was a guarantor and for recovering the outstanding amount, the Bank initiated proceedings. The petitioner earlier filed W.P.(C) No. 13896 of 2012, which was disposed of on 21.11.2012 leaving it open to the petitioner to either settle the loan account by way of paying the entire outstanding or approaching the Bank for rephasement.
Accordingly, the petitioner approached the Bank and vide letter dated 27.11.2012, the Bank took a decision in the matter.
Against the said decision, the present writ petition has been filed.
On 7.2.2013, interim order was passed staying coercive action subject to the petitioner depositing a sum of Rs. 63,200/- on or before 28.3.2013 and also giving liberty to the petitioner to seek waiver of interest/penal interest along with the second installment.
The petitioner has failed to make payment in terms of the order of this Court.
In these circumstances, no further order is called for by this Court.
Accordingly, the petition is dismissed without prejudice to any other remedy in accordance with law.
Learned counsel for the Bank fairly states that if any representation is filed by the petitioner, the Bank will take a decision thereon in accordance with law.
