Judgment
Both the sides are present. Counsel for R1 and R2 has filed an affidavit stating therein that the R1 and R2 are ready to hand over the property mentioned in the Application. However, there are some personal belongings of the Respondents, for which an Advocate Commissioner is required to be appointed to prepare an inventory, take over the possession of the immovable property on behalf of the Liquidator, which is the subject matter of the Application. The Counsel for the Applicant did agree to the suggestion made.
In view of the submissions of the Counsels for both the sides, I hereby appoint Mr. Rohan Rajasekaran as an Advocate Commissioner with the direction to inspect the subject property and prepare the inventory in the presence of both the parties or their representatives and take possession of the vacant property on behalf of the Liquidator. The Advocate Commissioner is directed to prepare the inventory in two parts; one is of the belongings of Respondents and other of the immovable assets of the Company under liquidation and shall file the status report on next date of hearing.. The Liquidator shall pay Rs.30,000/- as remuneration to the Advocate Commissioner.
At this stage, the Directors viz., R1 and R2 are present in person and their presence is dispensed with for next date of hearing.
