Petitioner was Assistant Teacher (L.T. grade), who was retired after the age of superannuation on 31.12.2024. According to her, she has not been granted promotional pay-scale, which every teacher is entitled to, after putting in 22 years of service.

By means of this writ petition, petitioner has sought writ of mandamus commanding the Respondents to forthwith grant the benefit of Promotional Pay Scale (Grade Pay of Rs.5400/-) to the petitioner from due date and also to pay the arrears of the same from due date.

Learned counsel for petitioner relied upon a judgment dated 18.06.2021 rendered by Coordinate Bench of this Court in Writ Petition (S/S) No.665 of 2021 Birendra Singh Barthwal Vs. State of Uttarakhand and Others, and he submits that the issue involved in this writ petition is identical.

Learned State Counsel does not dispute aforesaid statement made by learned counsel for petitioner.

In such view of the matter, the writ petition is disposed of, in terms of judgment dated 18.06.2021 rendered in Writ Petition (S/S) No.665 of 2021. Petitioner shall be at liberty to make representation to concerned Additional Director of Education. If petitioner makes such representation within three weeks from today, concerned Additional Director of Education shall take decision on petitioner’s representation, as per law, within eight weeks from the date of receipt of representation alongwith certified copy of the order.
