Judgment

Present writ petition has been filed under Article 226/ 227 of the Constitution of India for issuance of a writ in the nature of Mandamus, directing respondent No.1 to release the salary for the period of maternity leave from 08.08.2018 to 08.02.2019 and 10.10.2018 to 10.04.2020.
At the outset, instead of pressing the petition on merits, learned counsel for the petitioner has submitted that he would be satisfied in case the legal notice dated 28.05.2019 (P-3) submitted by the petitioner is decided by the competent authority, expeditiously, by passing a speaking order.
Prayer seems to be justified.

Ms. Shruti Jain, DAG Haryana accepts notice on behalf of the respondents. Learned State counsel is not averse to the innocuous prayer made by the petitioner.
In view of the agreed stand taken by both sides, but without going into the merits of the case, this Court deems it appropriate to dispose of the present petition with a direction to respondent No.1 to consider and decide the legal notice dated 28.05.2019 (P-3), if the same is pending, in accordance with law by passing a speaking order, expeditiously, preferably by 31.08.2020.
Ordered accordingly.
Needless to say that in case, the petitioner feels aggrieved against the order so passed, then she would be at liberty to take recourse to the remedy available under law.
