The instant petition has been filed for the grant of following substantive reliefs:-

That a writ in the nature of mandamus may kindly be issued directing respondents to permit present petitioner to appear in SOS 8th class examination as a special case after relaxing age criteria in the interest of justice.

That respondent No. 2 being competent officer may kindly be directed to issue necessary certificate to enable respondent No. 4 to relax the age criteria of petitioner to appear in SOS 8th class examination.

Record reveals that the petitioner was born on 12.03.2014 and in this manner has completed seven years of age. It is on account of exceptional performance that she has now been promoted to third standard in the DAV Public School, Palampur, District Kangra. Sh. V. K. Yadav, Principal of the school is present here and acknowledged the fact that the child is an exceptional as compared to other children of her age but states that permitting her to appear in the 8th examination would be putting the child to tremendous pressure and as an educationist would be advising against this proposal. He further states that till now the school has not conducted any examination and the report cards are solely based on the performance of the child in the school and her over all activities.

We have considered the matter and agree with the Principal that exposing a child of this tender age of seven years to examination of 8th class of which some of the subjects may be totally alien to the petitioner would be putting the child to undue pressure. However,in case in future the child does show some exceptional traits, then she is at liberty to approach this Court as well as the authorities, but for the present, the prayer of the petitioner cannot be acceded to. Accordingly, the petition is dismissed, so also pending application(s), if any.
