The petitioner has filed the instant writ petition under Articles 226/227 of the Constitution of India seeking a writ of certiorari, quashing the order dated 30.12.1996 (Annexures P-2 & P-3), whereby the persons junior to the petitioner have been appointed as Helpers on work-charge basis in the regular pay scale of Rs.800-1455, without considering the case of the petitioner. Further seeking a writ of mandamus, directing the respondents No.1 to 3 to consider and appoint the petitioner on work-charge basis and grant him regular pay scale of Rs.800-1455 with all consequential benefits with interest @ 18% per annum.

Learned counsel for respondents No.1 to 3 submits that since the services of the petitioner and respondents No.4 and 5 have been regularized on 13.06.2003, therefore, the instant petition has been rendered infructuous.

Learned counsel for the petitioner submits that the petitioner may be given liberty to represent the respondents No.1 to 3 in case any grievance is still left.

Disposed of as having become infructuous with liberty as aforesaid.
