The petitioner, an 86 year old person, has approached this Court seeking intervention regarding construction of a building for her residence. It is stated that the building where she is residing is having a tiled roof which has been damaged during the flood and the building itself is standing in a dangerous condition. Petitioner submitted Ext.P2 application before the Municipality, which according to the petitioner, was not considered.
The standing counsel for the Municipality on instructions submitted that the application which has been preferred by the petitioner is one which says only about changing of roof and not about a fresh construction. It is submitted that if a proper application is filed, the same will be considered by the Municipality.
In such circumstances, the writ petition is disposed of directing the petitioner to file a proper application for building permit before the 4th respondent within 10 days from today. On receipt of the application, the 4th respondent shall consider the same and pass orders within two weeks thereafter.
