This Criminal Original Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.Niranjan S Kumar, Advocate for the Petitioner and of M/s.E.Antony Sahaya Prabhakar, Additional Public Prosecutor,for the respondent No.1, this Court made the following order:
“This petition is filed to quash the proceedings in C.C.No.65 of 2017 on the file of the Judicial Magistrate, Tirumangalam.
The case of the petitioner is that for the incident said to have taken place in the year 2008, final report was filed in the year 2011 and was also taken on file in the year 2017. Some of the offences have been deleted. The learned counsel for the petitioner submits that it is a politically motivated complaint.
Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, takes notice for the 1st respondent.
Issue notice to the 2nd respondent returnable by 15.04.2024. Private notice is also permitted.
The learned Additional Public Prosecutor is directed to file a report as to the reasons for filing final report, after a period of 3 years.
The learned Judicial Magistrate, Tirumangalam, is also directed to explain as to the reason for taking cognizance, after a period of 6 years of filing final report.
