This civil petition is filed by the petitioner against Misc. No. 1067/2001, pending on the file of the City Civil Judge at Bangalore, seeking transfer of the said case to the District Court at Gadag.

I have heard the learned counsel for the petitioner. The respondents are served but not represented.

Having regard to the provisions of Section 31(1) of the said Financial Act, 1951 a petition filed u/s 31 has to be within the territorial jurisdiction of the District Judge within whose limits the industrial concern carries on the whole substantial part of the business. In the instant case, the industrial unit is located at RS405A/5 and 405/5A (Navalgund), Dharwad District. Therefore, the civil petition is allowed and Misc. No. 1067/2001 is withdrawn from the Court of City Civil Judge at Bangalore and transferred to the Court of Prl. District Judge, Dharwad, for disposal in accordance with law.

The Registrar, City Civil Court, Bangalore, to take appropriate steps in the matter.
