Judgment
IN this complaint the complainants have prayed for the following reliefs:- (1) Refund of the caution fee of Rs 500/-in full with interest at 18% per annum. (2) Reimburse the bus fare of Rs. 875/- at the rate of Rs. 5/-per day. (3) To pay compensation of Rs. 1,00,000/- for the loss of a precious academic year caused by the management to the student due to its callous and negligent attitude. (4) To direct them to return all the original documents received by them from complainant No. 3.
THE complainant No. 3 was admitted to the B.E.I. Pre-University College for the First Year PUC Course during June 1990. She took PCMB as her optionals. She paid Rs. 1,000/-towards tuition fee and caution money at the time of joining. THE 2nd complainant was trying to get fee exemption as his daughter, the 3rd complainant belonged to Scheduled Caste. Complainant No. 3 submitted her application to the Principal for being forwarded to the Social Welfare Board. THE Principal did not forward the application thinking that she would get fee concession. She did not pay the fee for the 2nd term inspite of reminders from the College Authorities. THEn the College Authorities did not allow her to attend the College inspite of her requests for time. She was not allowed to take her examination. Hence, she has filed this complaint for the said reliefs. The complaint is resisted by the respondents by contending inter-alia that the complainant No. 3 was admitted to Sri Hombegowda Pre-University College, which is recognised by the Government of Karnataka and not to the B.E.T. Pre-University College; that the application of the complainant No. 3 to the Social Welfare Board was not forwarded as there was discrepancy in the income of the parent given in the application for admission and the application for free studentship; that she was not allowed to take the examination as she had not paid the fees; that they are willing to return the caution money and the records and that they are not liable to pay any compensation.
They have produced the xerox copy of the application form filed by complainant Nos. & 3, while seeking admission. That application was filed for admission to the Hombegowda Pre-University College and not for B.E.T. College. So there was no reason for the complainants to think that the complainant No. 2 was admitted to the B.E.T. College. The receipt given to the complainants towards payment of fees no doubt it of the B.E.T. College. But the Advocate for the respondents states that both institutions are sister institutions and the receipt book of one institution can be used to give receipt for having received the fee by the other institution. Merely because the receipt was of the B.E.T. College, it cannot be said that she was admitted to the B.E.T. College. It is admitted that complainant No. 3 did not pay the fees for the 2nd term and that even for the I term, she was due to pay Rs. 176/-. In the application for admission to the College, the father''s income was shown as Rs. 48,000/- p.a., but in the application for fee concession to the Social Welfare Board, her father''s income was shown as Rs. 36,000/-. According to the Principal, he did not forward the application because of the discrepancy and told the said fact to the student. It is not shown that any explanation was offered by the father of the student to the Principal in that regard. Hence, the Principal cannot be blamed for not forwarding the application. As the student has not paid the fees as per rules, the College Authorities were justified in not allowing her to attend the College and to take the examination. Hence, the student is not entitled to any compensation. The learned Counsel for the respondents paid Rs, 500/-to the Counsel for the complainants towards return of caution money. The caution money is to be paid to the student after the academic year is over. Hence, the student is not entitled to any interest on that amount. The Principal is willing to deliver the original records of the student to her and assures that he would send them by Registered Post by tomorrow to the student. The complaint is accordingly disposed of. No costs. Complaint dismissed.
