Judgment
Heard.
The petitioner before this Court has filed this present writ petition being aggrieved by the improper pay fixation done by the respondents. The contention of the petitioner is that he was appointed as a Telephone Attendant and was rightly fixed by the State Government in the pay scale of Rs.825-1220 as per the Circular of the State Government dated 4/9/1996. The petitioner's grievance before this Court is that the respondents have later on fixed him in the pay scale of Rs.750-945.
An identical issue has been looked into by this Court in W.P. No. 452/2015. Relevant paragraph of the order passed by this Court reads as under :
Learned counsel for the appellant has drawn our attention to the page â. 51 Letter No.8152, Bhopal dated 04/09/1996 of Engineer- in-Chief/PHE Department, Bhopal whereby the State Government after obtaining approval from the Finance Department revised a pay scale from time to time, as is evident from the aforesaid letter. Relevant of the letter dated 4/09/1996 rads as under :-
प्रकरण में मध्यप्रदेश शासन, वित्त विभाग के अधिसूचना क्रमाक 605/2099/77/ आर 1/चार दिनांक 1.8.77 के परिशिष्ट में पुनरीक्षित वेतन निर्धारण के नियम - 3 के अन्तर्गत टेलीफोन क्लर्क के स्थान पर टेलीफोन अटेन्डेन्ट का नाम दिया गया था जिसका वेतनमान रूपये 90.170 दिनांक 1-1- 74 से देय था। मध्यप्रदेश कार्यभारित तथा आकस्मिकता से वेतनपाने वाले कर्मचारी वेतन पुनरीक्षित नियम 1984 जो मध्यप्रदेश वित्त विभाग के अधिसूचना क्रमांक 525-4323नि-1/चार दिनांक 3-3-84 द्वारा लागू किया गया था दिनांक 1-4-82 से प्रभावशील जिसके अनुसार वेतनमान 90-170 को पुनरीक्षित वेतनमान रूपये 445-635 में मान्य किया गया । मध्यप्रदेश कार्यभारित तथा आकस्मिकता से वेतन पाने वाले कर्मचारी वेतन पुनरीक्षण नियम 1987 जो वित्त विभाग के ज्ञापन क्रमांक 411-1628-87-नि-1-चार दिनांक 3-8-87 द्वारा दिनांक 1-1-86 से मान्य किया गया है अनुसार वेतनमान रूपये 445-635 को वेतनमान रूपये 775-1200 मान्य किया गया । इस वेतनमान को पुन : पुनरीक्षित करते हुये मध्यप्रदेश कार्यभारित वेतन पुनरीक्षित नियम 1990 जो वित्त विभाग के ज्ञापन क्रमांक 114-90-नि-1-चार जो मध्यप्रदेश राजपत्र में दिनांक 3-5-90 को प्रकाशित किया है को दिनांक 1-1-86 से लागू किया गया, के अनुसार वेतनमान रूपये 775-1200 का वेतनमान रूपये 825-1220 मान्य किया गया।
From the aforesaid, it is not in dispute that from 1/01/1986 pay scale was revised to 825-15-900-20-1220. Thereafter, as per schedule of Rule-4 of Seva Dainik-Karyabharit Tatha Akasmikta Karmchari Niyam, pay scale of 825-15-900- 20-1220 was revised to 2750-70-3800-75-4400 w.e.f. 1/1/1996 though the notification was issued on 26/06/1998.
In view of the aforesaid, no further approval from the Finance Department as raised by the State before the Writ court is required.
Accordingly, the impugned order is partly set aside with a direction that the appellant was rightly granted pay scale of Rs.2750-70-3800-75-4400.
In the light of the aforesaid judgment passed in Writ Petition No.452/2015, the present Writ Petition is allowed. The impugned recovery ordered by the respondents is set aside. The petitioner shall be entitled for pay scale of Rs.825-1220 with all consequential benefits. The amount already recovered, if any, be refunded back to the petitioner, within a period of sixty days from the date of receipt of certified copy of this order.
