Hon''ble Sudhanshu Dhulia, J.—Heard Mr. Bhagwat Mehra, Advocate for the petitioner and Mr. N.P. Sah, Standing Counsel for the State of Uttarakhand.

After hearing the learned counsel for the petitioner as well as the State Counsel, both the parties have agreed that the petition be disposed of at this stage itself.

According to the petitioner, he was working as a "Shiksha Acharya" since 1.1.2006 and as per the present Government Orders in force in the State of Uttarakhand, he is liable to be made a "Shiksha Mitra". However, this is being denied to the petitioner, as his appointment (as "Shiksha Acharya") is being considered from 27.11.2006 and not from 1.1.2006. This is the sole controversy in the present writ petition.

Be that as it may, the writ petition is disposed of with the direction to the District Project Officer (i.e. respondent No. 3) to hear the present petitioner, particularly as to his appointment as "Shiksha Acharya" from 1.1.2006 and if it is correct and the petitioner is otherwise eligible to be made "Shikha Mitra", the same shall be considered as expeditiously as possible, but definitely within a period of four weeks from the date a certified copy of this order is produced before him.
