Judgment
(per Mr. Manoj Kumar Gupta, C. J.)
The present public interest litigation has been filed by the petitioner praying for the following relief:-
“I. Issue a writ, order or direction in the nature of mandamus directing for holding of an inquiry into the misappropriation and embezzlement of the Govt. money of Zila Panchayat Pauri Garhwal to the tune of Rs. 75 lakhs by the private respondent nos.8 and 9 in collusion with each other, in award of Contract for work of cleanliness in 15 Development Blocks of Zila Panchayat Pauri through an independent Investigating Agency/Central Bureau of Investigation (CBI) in a time bound manner, inasmuch as the same also been pointed out in the Audit Report.”
Indisputably, the petitioner had earlier approached this Court by way of WPPIL No.51 of 2022 in which also the issue relating to corruption in various development works under Zila Panchayat, Pauri Garhwal was raised by the petitioner. The said writ petition is still pending.
In such view of the matter, we are not inclined to entertain any independent petition on the same issue. The writ petition is, accordingly, dismissed with liberty to the petitioner to bring additional facts on record of the said case by means of supplementary affidavit, if so advised.
The present PIL is, accordingly, dismissed.
